§ 1. General Provisions

  1. These Terms & Conditions set out the general conditions and rules for using the Online Store, as well as the manner of providing electronic services and conducting sales through the Online Store at www.viscoto.com.
  2. The online store is operated by PARO PAULINA WALKOWICZ, ul. Zygmunta Starego 1E/20, 30-198 Kraków, VAT no.: 7532394084, REGON: 161468534, hereinafter referred to as the “Seller”.

  4. These Terms & Conditions are continuously available on the website www.viscoto.com in a manner that allows their content to be retrieved, reproduced, and saved by printing or saving to a device at any time.
  5. The Seller informs that using services provided electronically may involve risks for any internet user. To minimise risk, the Customer should use appropriate technical measures, in particular antivirus software and a firewall.
  6. These Terms & Conditions are available in Polish.

§ 2. Definitions

Terms used in these Terms & Conditions have the following meanings:

  • Customer — a natural person with full legal capacity, a natural person conducting business activity, a legal person, or an organisational unit without legal personality that has been granted legal capacity by specific regulations, who places an order or uses the services of the Online Store;
  • Consumer — a Customer who is a consumer within the meaning of Article 22(1) of the Civil Code;
  • Entrepreneur with Consumer Rights — a natural person conducting business activity who enters into a contract directly related to that activity, but which is not of a professional nature for that person (pursuant to Article 38a of the Consumer Rights Act, as amended from 1 January 2021);
  • Entrepreneur — a Customer who is an entrepreneur within the meaning of Article 43(1) of the Civil Code, excluding Entrepreneurs with Consumer Rights;
  • Online Store / Store — the website available at www.viscoto.com through which the Customer may place orders;
  • Account — the part of the Online Store assigned to the Customer, through which they may perform certain actions within the Store;
  • Product — a product presented in the Online Store, the description of which is available on each product page;
  • Sales Agreement — a contract for the sale of Products concluded between the Seller and the Customer through the Online Store;
  • Order — a declaration of intent by the Customer aimed directly at concluding a Sales Agreement, specifying the type and quantity of the Product;
  • Terms & Conditions — this document.

§ 3. Technical Requirements

  1. Use of the Online Store requires the Customer’s IT system to meet the following minimum technical requirements:
    • a device with internet access (computer, tablet, smartphone);
    • an active email account;
    • a web browser: Chrome 80+, Firefox 75+, Safari 13+, Edge 80+ or newer;
    • cookies and JavaScript enabled in the browser.
  2. The Seller is not responsible for technical issues resulting from the configuration of the Customer’s device or browser.

§ 4. Electronic Services

  1. The Seller provides the following free electronic services through the Online Store, available 24 hours a day, 7 days a week:
    • maintaining a Customer Account;
    • enabling the placement of Orders;
    • sending a Newsletter (upon consent).
  2. The Account service is available after registration by completing a registration form and accepting these Terms & Conditions. The agreement for maintaining an Account is concluded for an indefinite period.
  3. The Customer may delete their Account at any time by sending a request to office@viscoto.com. Deletion of the Account does not affect the fulfilment of previously placed orders.
  4. The Newsletter service is provided upon submission of an email address and express consent. The Customer may unsubscribe from the Newsletter at any time by clicking the unsubscribe link in any message or by writing to office@viscoto.com.
  5. In the event of a Customer’s breach of these Terms & Conditions, the Seller may — after an unsuccessful request to cease the breach with a 7-day deadline — terminate the service agreement with a 14-day notice period.

§ 5. Order Placement Process

  1. Information about Products presented in the Store constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code, not an offer within the meaning of Article 66 of the Civil Code.
  2. All Products available in the Store are brand new, free from physical and legal defects.
  3. An Order is placed by adding a Product to the cart, completing the order form (delivery details, payment method), and clicking the “Order and pay” button. Clicking this button constitutes placing an order with an obligation to pay.
  4. Before placing an Order, the Customer may verify and correct all entered data.
  5. After an Order is placed, the Seller promptly confirms receipt and simultaneously accepts it for fulfilment. Confirmation is sent by email containing: the order number, a summary of ordered Products, the total price including delivery costs, and payment details.
  6. The Sales Agreement is concluded at the moment the Seller sends an email confirming acceptance of the Order for fulfilment.
  7. The Seller reserves the right to cancel an Order if the Product is unavailable or if the Customer does not pay within 3 business days of placing the Order (in the case of prepayment). The Seller will notify the Customer of any cancellation without delay.

§ 6. Prices and Payment Methods

  1. Product prices are given in Polish zloty (PLN) and include VAT and all other components. Delivery costs are displayed separately during the order process, before final confirmation.
  2. The Seller reserves the right to change Product prices and to run or cancel promotional offers. Price changes do not apply to Orders already placed and confirmed.
  3. The Customer may choose from the following payment methods:
    • bank transfer to the Seller’s bank account;
    • cash on personal collection;
    • cash on delivery;
    • online payment via TPay or PayPal;
    • payment card: VISA, MasterCard.
  4. The operator of card and TPay payments is Krajowy Integrator Płatności S.A. (PayPro SA), ul. Kanclerska 15, 60-327 Poznań, KRS: 0000347935, VAT no.: 7792369887.
  5. For bank transfer or online payments, the Order is processed after the payment is credited to the Seller’s account.
  6. The Seller issues a receipt or VAT invoice in accordance with the Customer’s choice made during the order process. Invoice details must be provided no later than at the time of placing the Order — issuing an invoice after payment has been credited may not be possible.

§ 7. Delivery

  1. Products are delivered within the European Union, to the address specified by the Customer in the Order.
  2. Orders are fulfilled within 48 business hours of payment confirmation (or order placement in the case of cash on delivery). For Products not immediately available, the fulfilment time is indicated on the product page.
  3. Available delivery options:
    • courier delivery;
    • personal collection at the Seller’s address (by prior arrangement).
  4. Delivery costs depend on the chosen delivery method and are displayed to the Customer before placing the Order.
  5. Upon handover of the Product to the carrier, the risk of accidental loss or damage passes to Customers who are not Consumers. For Consumers, the risk passes when the Consumer takes possession of the Product.
  6. The Customer should inspect the parcel in the presence of the courier. In the event of damage, a damage report should be drawn up, which will facilitate the handling of any complaint.

§ 8. Right of Withdrawal

  1. A Consumer or Entrepreneur with Consumer Rights who has concluded a Sales Agreement may withdraw from it without giving a reason within 14 days from the day on which they took possession of the Product, or on which a third party other than the carrier designated by the Consumer took possession of the Product.
  2. It is sufficient to send a statement of withdrawal before the deadline expires. The statement may be submitted:
    • in writing to: ul. Zygmunta Starego 1E/20, 30-198 Kraków;
    • by email to: office@viscoto.com;
    • using the withdrawal form constituting Annex No. 1 to these Terms & Conditions.
  3. The Seller will refund all payments made by the Consumer, including delivery costs (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard option), promptly and no later than 14 days from receipt of the withdrawal statement. The refund is made using the same payment method used by the Consumer, unless they have expressly agreed to a different solution.
  4. The Seller may withhold the refund until the Product has been returned or the Consumer has provided proof of return.
  5. The Consumer is obliged to return the Product to the Seller’s address promptly, no later than 14 days from the date of withdrawal. The direct cost of returning the Product is borne by the Consumer.
  6. The Consumer is liable for any diminishment in the value of the Product resulting from use beyond what is necessary to establish its nature, characteristics, and functioning.
  7. The right of withdrawal does not apply to the Consumer in cases specified in Article 38 of the Consumer Rights Act, including Products manufactured to the Consumer’s specifications or clearly personalised.

§ 9. Complaints and Warranty

  1. The Seller undertakes to deliver Products free from defects.
  2. The Seller is liable to the Consumer for non-conformity of the Product with the agreement on the terms set out in the Act of 30 May 2014 on Consumer Rights (as amended from 1 January 2023, implementing the Omnibus Directive).
  3. For Customers who are Entrepreneurs (excluding Entrepreneurs with Consumer Rights), statutory warranty for defects is excluded pursuant to Article 558 § 1 of the Civil Code.
  4. A complaint may be submitted:
    • by email: office@viscoto.com;
    • in writing: ul. Zygmunta Starego 1E/20, 30-198 Kraków.
  5. A complaint should include: name and surname, contact details, description of the defect or non-conformity with the agreement, the date it was identified, and the Customer’s claim. We recommend attaching proof of purchase and photographs.
  6. The Seller will respond to a complaint within 14 days of receipt. Failure to respond within this period is deemed acceptance of the complaint by the Seller.
  7. The Consumer may request: repair, replacement of the Product, a price reduction, or — in the case of material non-conformity — withdrawal from the agreement.

§ 10. Price Information — Omnibus Directive

  1. In accordance with the requirements of the Omnibus Directive (2021/771/EU) implemented into Polish law by the Act of 1 December 2022, for every price reduction the Seller displays information about the lowest price of the Product applicable during the 30 days prior to the introduction of the reduction.
  2. For Products that have been on sale for less than 30 days, the Seller displays the lowest price applicable since the Product was introduced for sale.
  3. Product reviews presented in the Online Store come exclusively from Customers who have purchased the Product in question. The Seller verifies the authenticity of reviews by checking order history.

§ 11. Out-of-Court Dispute Resolution

  1. The Consumer has the right to use out-of-court methods of handling complaints and pursuing claims:
    • applying to a permanent consumer arbitration court at the Trade Inspection;
    • applying to the regional Trade Inspection inspector to initiate mediation proceedings;
    • free assistance from a district (municipal) consumer ombudsman or consumer organisations (including the Consumer Federation — tel. 800 007 707, porady@dlakonsumentow.pl);
    • submitting a complaint via the EU ODR platform: https://ec.europa.eu/consumers/odr/
  2. Use of out-of-court dispute resolution methods is voluntary. This provision is for informational purposes only and does not obligate either party to use these procedures.

§ 12. Personal Data Protection

  1. The controller of Customers’ personal data is PARO PAULINA WALKOWICZ, ul. Zygmunta Starego 1E/20, 30-198 Kraków.
  2. Customers’ personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Privacy Policy available at: https://viscoto.com/polityka-prywatnosci/
  3. Detailed information on the processing of personal data, including Customers’ rights, is contained in the Privacy Policy.

§ 13. Final Provisions

  1. All rights to the Online Store, including economic copyright, intellectual property rights to the name, domain, logos, and forms, belong to the Seller. Use thereof beyond the scope defined in these Terms & Conditions requires prior consent from the Seller.
  2. The Seller reserves the right to amend these Terms & Conditions. Customers will be notified of any changes via a notice on the Store’s homepage at least 14 days before the changes take effect. Customers with an Account will additionally receive notification by email.
  3. A Customer with an Account who does not accept the changes to the Terms & Conditions may terminate the Account agreement by submitting an appropriate statement within 14 days of being informed of the change.
  4. Disputes with Consumers are resolved by the court with jurisdiction under the provisions of the Code of Civil Procedure. Disputes with Entrepreneurs are resolved by the court with jurisdiction for the Seller’s registered address.
  5. Matters not regulated by these Terms & Conditions are governed by: the Civil Code, the Consumer Rights Act, the Act on the Provision of Electronic Services, and other applicable provisions of Polish law and European Union law.
